Philadelphia man with Florida gun permit convicted in killing

A Philadelphia man who received a Florida permit to carry a gun after Philadelphia police stripped him of his Pennsylvania gun permit was sentenced to prison Thursday in the shooting death of a teen in the city's Olney section.

Marqus Hill, 29, was sentenced by Common Pleas Court Judge Glenn B. Bronson to eight to 20 years in prison in the September 2010 killing of 18-year-old Irving Santana. Santana was allegedly one of three teens who broke into Hill's car in the 300 block of East Gale Street. He was shot 13 times.

Hill, of Hunting Park, who was convicted of third-degree murder and possession of an instrument of crime, had drawn criticism from police and others for using a loophole that allowed him to carry a gun after police had stripped him of his Pennsylvania permit to carry a firearm.

Hill, who had a previous charge of attempted murder dismissed, was denied a permit to carry a gun in Philadelphia in 2008.

The case highlighted what police and others said was a loophole that allows nonresidents of three states - Florida, Utah, and New Hampshire - to get gun permits even if their home states have denied or revoked permits for them.

Hill lost his Philadelphia-issued permit in 2005 after what authorities described as "significant contact" with police.

He appealed the revocation of his gun permit in 2008, but it was upheld.

A year later, Hill was granted a permit from Florida that was to expire in 2016.
