Metal company challenges competitor’s patents

Carpenter Technology Corp. of Reading said today that it filed a lawsuit against Pittsburgh-based Allegheny Technologies Inc., alleging that two U.S. patents obtained by Allegheny were not valid.

Carpenter Technology Corp. of Reading said today that it filed a lawsuit against Pittsburgh-based Allegheny Technologies Inc., alleging that two U.S. patents obtained by Allegheny were not valid.

Carpenter Technology filed the suit in U.S. District Court in Philadelphia, challenging the validity of patents 564 and 858, relating to a method of producing and manufacturing 30-inch-diameter 718 ingots of nickel-based alloys.

Both companies manufacture and sell specialty metals worldwide.

Carpenter plans to produce its own nickel-based 718 ingots in sizes 30 inches and larger, and seeks a court ruling that it is not infringing on Allegheny's patents, the suit said.

Allegheny Technologies said today that it does not comment on litigation.

Carpenter was priced at $46.62, up $1.09 (2.39 percent) in midafternoon trading on the New York Stock Exchange, where Allegheny was trading at $63.57, up $0.93 (1.48 percent).
