The U.S. Court of Appeals Third Circuit has dismissed blueberry heir Anthony DiMeo's motion to reverse the District Court's decision to dismiss his lawsuit against author/blogger Tucker Max over comments on Max's Website that DiMeo found derogatory. DiMeo filed suit against Tucker Max in early 2006 after the blogger’s site featured several threads full of reader comments which mocked DiMeo, an heir of New Jersey's DiMeo Farms blueberry business, with various degrees of profanity and crude humor. Max filed a motion to dismiss, which was granted by the U.S. District Court, and DiMeo's Third Circuit Court filing
