Philadelphia police fatally shot a man who refused to drop his gun and fired first at police early Saturday, authorities said.

Police spokesman Lt. Raymond Evers said two uniformed officers from the 25th District in a marked car responded to a radio call of a person with gun about 12:43 a.m. at Ninth and Pike Streets in the Hunting Park section of the city. Officers saw Adolphus Pinkney, 26, of the 3900 block of North Delhi,,in the street holding a gun.

"The officers told him several times to drop the gun and he did not," Evers said.

Pinkney fired at the two officers, missing them, Evers said. Both officers returned fire, Evers said.

Pinkney was pronounced dead at the scene, he said.

Four empty shell casings were found in the .38-caliber revolver recovered from Pinkney's body, Evers said. Police also found a pellet gun, which looked like a semiautomatic pistol, in Pinkney's waistband, Evers said.

Pinkney had entered Olga's Sport Lounge on North Ninth Street, but patrons forced him outside, locked the doors, and called 911, 6ABC reported. Police could not immediately confirm that.

The two officers have been assigned to desk duty pending the outcome of the investigation by the Philadelphia District Attorney's Office and the police Internal Affairs unit, standard protocol for officers involved in shootings.

Authorities said Pinkney had five convictions in Philadelphia on charges including aggravated assault, robbery, and drug possession.
