A Florida appeals court yesterday upheld a judge's ruling that allows

to be buried in the Bahamas, agreeing that the evidence indicates that was what the former Playboy Playmate wanted.

The starlet's estranged mother, Virgie Arthur, challenged last week's ruling by Judge Larry Seidlin, who gave control of the body to an advocate for Smith's 5-month-old daughter. Arthur wanted to bury her daughter in her native Texas.

But Smith's boyfriend, Howard K. Stern, had argued that she had wanted to be buried in the Bahamas next to her 20-year-old son, who died last year of apparent drug-related causes. The 4th District Court of Appeal in West Palm Beach agreed. The trial court concluded that Smith's "last ascertainable wish" was to be buried alongside her son, the appellate judges said in their ruling. "This finding is not essentially disputed."

It was not immediately clear when Smith's body would be transported, but attorney Richard Milstein, the baby's advocate, has said a funeral in the Bahamas could be held as early as today.

Smith's body has been stored at a medical examiner's office since shortly after she died Feb. 8 at age 39. A cause of death has not been released.

Andre Leon Talley guided the new star through the awards season, helping style her for major appearances after the success of Dreamgirls. Hudson wore a brown Oscar de la Renta gown for the Academy Awards ceremony and added a metallic gold bolero jacket to walk the red carpet. But the star was slammed for her appearance and admitted on Today that she would have selected a different outfit.

A source tells PageSix.com, "Jennifer was kind of sponsored by Talley and Vogue. Andre insisted she wear that hideous Oscar de la Renta dress with the awful, awful gold python bolero. Jennifer really didn't want to, and so [celebrity stylist] Jessica Paster got her a beautiful gold Roberto Cavalli [gown] custom-made. But when Andre found out, he went ballistic. Moments before she left for the show, there was a power struggle and Jennifer ended up putting his outfit on."

Although she didn't score on the red carpet, Hudson did take home the Oscar for best supporting actress.

The 26-year-old hotel heiress and star of The Simple Life was ticketed for misdemeanor driving with a suspended license after her blue Bentley Continental GTC was pulled over on Sunset Boulevard on Tuesday, Los Angeles County sheriff's Sgt. Duane Allen Jr. said.

She was stopped about 11 p.m. after authorities saw the car speeding with its headlights off, Allen said.

"Our office is waiting to obtain a copy of the citation," said Nick Velasquez, a spokesman for the Los Angeles city attorney's office. "Once we're able to verify that Miss Hilton was driving the vehicle, we will request that the court revoke her probation and set a probation violation hearing."

Hilton could face up to 90 days in jail if a judge finds she violated her probation, he said.

About 200 children will be able to attend the school in Bishnupur, a village about 30 miles south of Calcutta. "I am very happy that my efforts are fructifying. Things are changing with more and more children going to school," Lapierre told cheering students.

The school is one of 15 to be built in the state with $807,000 bid for the dress at a Christie's auction in London in December.

Lapierre had received the dress as a gift from designer Hubert de Givenchy. Proceeds from the sale went to the City of Joy Foundation, run by Lapierre to help India's poor.

The Hollywood icon was in a wheelchair when she came down the red carpet Tuesday, escorted by her 52-year-old son, Christopher Wilding, who shares the same birthday.

Taylor smiled and batted her trademark violet eyes as photographers sang "Happy Birthday." When asked the secret of her longevity, she quipped, "Hangin' in."

About 75 people were expected for a Mardi Gras-themed dinner of jambalaya, prime rib, collard greens, sweet potatoes and cake.

Guests including Debbie Reynolds, her daughter Carrie Fisher, magicians Siegfried & Roy, and model Kathy Ireland turned out for the private party.

Bear killer sentenced

, of the country singing duo Montgomery Gentry, has been sentenced to three months' probation and a $15,000 fine in Duluth, Minn., for killing a captive black bear. He also must give up hunting in Minnesota for five years.

Gentry pleaded guilty to a misdemeanor in November. In a plea deal, he agreed to forfeit the bear and the bow he used during the hunt near Sandstone. The 600-pound bear has been part of a taxidermy display at Gentry's home in Tennessee. He was sentenced Friday.

The bear was killed in October 2004 at the 80-acre Minnesota Wildlife Connection. Owner Lee Marvin Greenly sold the bear for $4,650 and orchestrated the hunt, which Gentry videotaped and edited to make it appear the bear had been killed in a fair chase hunt, according to authorities.

Montgomery Gentry, which includes singer Eddie Montgomery, is known for hits such as "My Town" and "If You Ever Stop Loving Me."
