Raymour & Flanigan “King of Prussia Room Makeover Seminar” Sweepstakes

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

Overview: There will be Two (2) Raymour & Flanigan “King of Prussia Room Makeover Seminars” held on Thursday, July 9, 2009. Seminar #1 will be held from 2:00 PM – 4:00 PM Eastern Standard Time (“EST”) and Seminar #2 will be held from 7:00 PM – 9:00 PM EST. Individuals may register online at www.philly.com for each seminar and registrants are invited to participate in the Raymour & Flanigan “King of Prussia Room Makeover Seminar” Sweepstakes by filling out an entry form, the day of the Seminar, at the Raymour & Flanigan King of Prussia Retail Store. Individuals may attend both seminars and must register separately for both.

Eligibility:  The Raymour & Flanigan “King of Prussia Room Makeover Seminar” Sweepstakes is open to legal residents of the 50 United States and the District of Columbia, age 21 or older at the time of entry. Void outside the US, in Puerto Rico, and wherever else prohibited by law. Employees of Raymour & Flanigan (the "Sponsor") and its subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members of, and/or those living in the same household of each, are not eligible to enter. Sweepstakes is subject to all applicable federal, provincial, state and local laws and regulations.

Entry: A written entry must be completed at the Raymour & Flanigan Furniture Store, 371 West Dekalb Pike, King of Prussia, PA 19406. Please follow all entry instructions to complete and submit the entry form. Entries must be received between 10:00 AM Eastern Time ("ET") on Thursday, July 9, 2009, and 8:59 PM (“ET”) on Thursday, July 9, 2009 (the "Sweepstakes Entry Period"). Limit: One (1) entry per person.

One (1) Grand Prize is being designated for each of the Two (2) Seminar Sweepstakes during the Sweepstakes Entry Period. Entries must be received during the Entry Period indicated in the chart below to be eligible for that seminar time period’s prize. Non-winning entries from Seminar #1 will not be rolled over to the subsequent seminar Entry Period for Seminar #2. They will only be eligible to win a prize for the seminar time period during which the entry is received and designated. If entrants are registered to attend both seminars they are eligible to win a prize during each seminar time period.

Prizes & Values:  There will be One (1) Grand Prize awarded that includes: One (1) Raymour & Flanigan Gift Card with an Approximate Retail Value (“ARV”) of $2,500 and One (1) Kristin Cunningham One-on-One Design Consultation with an (“ARV”) of $500, for each of the two (2) Seminars during the Sweepstakes Entry Period.

Total ARV of each of the two (2) Seminar Sweepstakes Prizes: $3,000.00 

Random Drawing: The winner for each designated seminar will be selected in a random drawing from among all eligible entries at the conclusion of each seminar (“Winner Selection Time”) on or about the corresponding time period noted in the chart above and will take place Thursday, July 9, 2009 at the Raymour & Flanigan Furniture Store, 371 West Dekalb Pike, King of Prussia, PA 19406.   

 Prize Conditions. Winners must be present at the conclusion time of the seminar to win. If the prospective winner is not present at the store or if eligibility requirements are not met, a prospective winner may be deemed ineligible. In such event, Sponsor may, at its discretion, either not award the prize or select an alternative prospective winner at random from all eligible entries received.

The prospective winner will be required to sign and submit the eligibility materials required, immediately upon being selected in the random drawing, at the conclusion of the seminar in the Retail Store. These materials include: an Affidavit of Eligibility, a Liability Waiver, and where allowable, a Publicity Release (collectively, "the Releases). The winner selection process may continue until a winner is determined.

The Kristin Cunningham One-on-One Design Consultation will take place immediately following the conclusion of the Seminar and the Raymour & Flanigan $2500 Gift Card will be awarded that same day on July 9. 2009 and no later than 30 days after the winner is verified as eligible. Furniture and Accessories will be at the price marked (regular or on sale), returns and exchanges for cash are not permissible and the prize may not be combined with any other Raymour & Flanigan offer and excludes prior purchases.

Failure to comply with these Official Sweepstakes Rules or to claim a prize may result in disqualification of the prospective winner. In such event, Sponsor reserves the right to determine if and when a prize will be re-awarded and the applicable terms

Prizes are non-assignable or transferable to another individual, except to a surviving spouse.

Prize is not redeemable for cash, and no substitution is permitted except if prize offered is unavailable, in which case the Sponsor reserves the right to award a prize of equal or greater value. Winner is responsible for all federal, state, local, provincial sales and income taxes, if applicable. Winner acknowledges that the Sponsor and all other businesses affiliated with this Sweepstakes and their agents do not make, nor are in any manner are responsible for any warranty, representations, expressed or implied, in fact or in law, relative the quality, conditions, fitness or merchantability of any aspect of the prize being offered.  Entry and acceptance of any prize constitutes permission for Sponsor or their agent(s) to use winner's name, prize won, hometown and likeness for online posting and promotional purposes without further compensation, except where prohibited by law. All prizes are guaranteed to be awarded.

General: Participating entrants agree to these Official Rules and the decisions of The US Sweepstakes & Fulfillment Company and the Sponsor, and release the Sponsor and their affiliated companies, and all other businesses involved in this Sweepstakes, as well as the employees, officers, directors and agents of each, from all claims and liability relating to their participation in the promotion, and the acceptance and use/misuse of the prize offered. Winner assumes all liability for any injury or damage caused or claimed to be caused, by participation in this Sweepstakes or use/misuse or redemption of the prize. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of any prize.

This Sweepstakes is subject to all applicable federal, state and local laws, rules and regulations. Entrants grant to Sweepstakes Entities the right to print, broadcast, use and publish their proper name, city and state, biographical information, photographs and likeness online and in print or any other media, for advertising and promotional purposes, in connection with the Sweepstakes, without additional compensation unless prohibited by law. Sweepstakes Entities reserve the right to disqualify any entry or entries, or any individual, they find to be tampering with the entry process or the operation of the game or website; to be acting in violation of these Official Sweepstakes Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SWEEPSTAKES ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. 

Limitations of Liability: If for any reason the Sweepstakes is not capable of running as planned due to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Sweepstakes Entities which corrupts or affects the administration, security, fairness, integrity or proper conduct of these Sweepstakes, Sweepstakes Entities reserve the right to disqualify any individual who causes any such problem, and to cancel, terminate, modify or suspend the Sweepstakes. Sweepstakes Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of entries.

Sweepstakes Entities are not responsible for misdirected, lost, late, illegible, forged, destroyed, or incomplete entries submitted manually, or entries not otherwise in compliance with these Official Sweepstakes Rules.

By entering this Sweepstakes, each entrant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs, associated with entering the Sweepstakes, but in no event will attorneys' fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to, punitive, incidental or consequential damages and/or any other damages other than actual out-of-pocket expenses. 

By accepting the prize, the winner agrees to release and hold harmless Sweepstakes Entities from any and all liability, claims or actions of any kind whatsoever, which may result from the receipt, enjoyment, ownership or use or misuse of such prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the entrant's rights of publicity or privacy, or the entrant's claim that he/she has somehow been defamed or portrayed in a false light).

Sweepstakes Entities do not assume any responsibility for any schedule changes in the Sweepstakes timeline, including without limitation, scheduling conflicts, labor strikes, Acts of God, or other unforeseen events that disrupt the Sweepstakes schedule. Sweepstakes Entities reserve the right to cancel, modify, or suspend this Sweepstakes.

ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL SWEEPSTAKES RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SWEEPSTAKES ENTITIES IN CONNECTION WITH THIS SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF PENNSYLVANIA WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS. THE INVALIDITY OR UNENFORCEABILITY OF ANY PROVISION OF THESE RULES SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHER PROVISION. IN THE EVENT THAT ANY PROVISION IS DETERMINED TO BE INVALID OR OTHERWISE UNENFORCEABLE OR ILLEGAL, THESE RULES SHALL OTHERWISE REMAIN IN EFFECT AND SHALL BE CONSTRUED IN ACCORDANCE WITH THEIR TERMS AS IF THE INVALID OR ILLEGAL PROVISION WERE NOT CONTAINED HEREIN. EACH PERSON WHO PARTICIPATES IN THIS SWEEPSTAKES AGREES THAT THE STATE AND FEDERAL COURTS LOCATED IN SYRACUSE, NY HAVE EXCLUSIVE JURISDICTION OVER ANY SUIT OR OTHER PROCEEDING ARISING OUT OF OR BASED UPON THESE OFFICIAL SWEEPSTAKES RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SWEEPSTAKES ENTITIES IN CONNECTION WITH THIS SWEEPSTAKES AND EACH HEREBY WAIVES ANY CLAIM THAT IS NOT SUBJECT PERSONALLY TO THE JURISDICTION OF SAID COURTS OR THAT ANY SUCH SUIT OR OTHER PROCEEDING IS BROUGHT IN AN INCONVENIENT FORUM OR IMPROPER VENUE.
