Toomey lacking on top-court pick

I note with dismay that Sen. Pat Toomey and his Republican colleagues continue to export their special brand of legislative dysfunction to the Supreme Court. On Friday, the court declined to schedule three important cases ("Short-handed Supreme Court delays action in 3 cases," Philly.com, Friday). Apparently, there is concern that the short-handed and evenly divided court would be unable to reach a decision. These cases, involving separation of church and state, class-action lawsuits, and property rights, were granted full-review status nine months ago, before Justice Antonin Scalia died, but have been put on hold indefinitely.

The Republican-controlled Senate has refused to consider the nomination of Judge Merrick Garland to fill the Supreme Court's vacancy. For the past seven months, Toomey has been front and center in refusing to fulfill one of the few duties that the Constitution requires a senator to complete. Toomey deserves a negative job-performance review on Nov. 8. Don't reward him for his do-nothing work ethic.
