Allentown penis-stabbing case dismissed after victim fails to show in court

Charges against an Allentown man accused of stabbing another man in the penis were dismissed Thursday after the victim didn't show up to testify, officials said.

Micie A. Colon, 22, of Allentown was retrieving his property Sept. 29 from a home on the 300 block of East Cumberland Street when police say he stabbed the victim.

Colon was charged with aggravated assault and related crimes and sent to Lehigh County Jail on $35,000 bail. However, the charges against him were dismissed Thursday after the alleged victim didn't show up to testify for a second time.

Deputy District Attorney Jeffrey Burd said that officers were unable to serve a subpoena to the victim requiring him to testify. Burd said he requested a continuance but his motion was denied and the charges were dismissed. He said if and when the victim is located, the charges will be filed again.

As Colon was getting his things together that September morning, he threw the victim's phone against a wall. When the man went to retrieve it, Colon attacked him from behind and a struggle ensued. Colon's girlfriend joined the fight but another person pulled her away, and during the scuffle the victim was cut on his penis.

Burd said he anticipates Colon will be released from prison sometime Thursday.
