Sentence tossed out for 11-year-old's rapist
AN APPEALS COURT has vacated the lengthy prison term of Jose Carrasquillo, the Kensington man who was pummeled by an angry mob after his picture was released following the rape of an 11-year-old girl.
The 6-3 opinion by the Superior Court found that a Philadelphia trial judge erred by not letting Carrasquillo, 30, withdraw his guilty plea before sentencing.
Tuesday's opinion vacated his sentence of 30 to 66 years in prison and ordered that he be retried for the June 2009 rape of the 11-year-old and the attempted assault of a 16-year-old girl.
The District Attorney's Office said it was disappointed by the ruling.
In addition to the victim's testimony and Carrasquillo's confession to police, prosecutors said there was DNA and fingerprint evidence linking him to the rape.
A vigilante mob had severely beaten Carrasquillo after recognizing a police sketch of the girl's assailant.
