Trial set in alleged murder plot

A man already in prison in a fatal assault is accused of trying to have an Ocean County prosecutor slain.

FREEHOLD, N.J. - Opening statements are scheduled to begin this week in the trial of a former Egg Harbor Township man charged with plotting to have an Ocean County prosecutor murdered.

Jay Goldberg, already serving a 20-year sentence for an April 2009 slaying, is on trial on charges of attempted murder and murder conspiracy.

He was acquitted of murder but convicted of aggravated assault in 2012 in the killing of a man with whom he operated a marijuana-growing facility. Goldberg's attorneys argued that he acted in self-defense.

A few months later, while he was awaiting sentencing, an inmate in the Ocean County jail said that Goldberg had solicited him to kill Steven Cucci, supervising Ocean County prosecutor.

Prosecutors say an undercover detective subsequently recorded incriminating conversations with Goldberg.

Goldberg's attorney could not be reached for comment Saturday. Cucci retired from the Ocean County Prosecutor's Office in January.
