CLEARWATER, Fla. -- J.C. Romero is being sued by the Florida man who accused Romero of striking him after a game at Tropicana Field last season.

Robert Eaton, 26, of New Port Richey, has filed a lawsuit in Pinellas County, claiming that Romero caused him serious and permanent injury on June 25, 2009, according to a report in the St. Petersburg Times.

Eaton alleges that Romero hit him in the neck when he was asking for an autograph. Eaton remembers calling Romero's attention by saying, "How about you get me some juice?" -- a reference to Romero's 50-game suspension last season for performance enhancing drugs. After St. Petersburg police investigated the claim and handed it to the state attorney's office, charges were not pursued because of conflicting accounts from witnesses.

"It happened, and it affected my life," Eaton told the Times.

Eaton is believed to be seeking at least $15,000 in damages. According to the report, Eaton could not enroll in firefighters school because he failed to pass a physical.

When asked about the lawsuit this morning, Romero said he did not want to discuss specifics.

"I'm trying to put it behind me," he said. "When something changes, I'll talk to you."

In actual baseball news, Romero will throw breaking balls off a mound for the first time on Sunday, general manager Ruben Amaro Jr. said. That's a big step for Romero, who has been limited to throwing fastballs with two days off in between each session. He's still a long shot for opening day.

Obviously you can't hit someone, but it sounds like the guy deserved it. That's the state of the nation these days, you can say anything you want to antagonize someone right to thier face and they have to take it. It's a tough one. Robert Eaton is Florida trash, but it will cost Romero.

He shouldn't have hit him, but no way he failed a physical because of it. Frivalous lawsuit, and I agree with you MD202020, but even worse is the lawyer who took this case.

Another ridiculous lawsuit from someone and their lawyer who want a payday for doing nothing. The allegation that he could not pass a physical because of some incident I'm sure is total bs.

The lawsuit is ridiculous, that's true. But Romero has had enough trouble without creating more for himself. Not good.

Hit him in the neck??? He should have taken his head off! Poor trash from Florida.... It makes me ashamed to say that I live here. Up in the Homeland, at least for the most part, when someone screws up for their actions they show some accountability instead of a million and one whiny excuses. The whole part this clown doesn't get is had he not spouted off the incident never would have occurred!

Romero had Roid Rage, how else can one explain his actions. The dude Eaton was trash, but Romero should have been the bigger man.

Bob Brookover and Matt Gelb team up for their third straight season covering the Phillies for the Inquirer and philly.com.

This is Brookover’s second stint writing about the Phillies, having joined the coverage team after seven years as an Eagles beat writer.
