The Supreme Court said today it will consider whether the government can make it a crime to sell or own videos portraying dog fighting or other acts of animal cruelty. The case involves a Virginia man who was arrested by federal agents for selling videos depicting dog fights.

A federal appeals court in Philadelphia last year declared a federal law making illegal to sell or posses videos of animals being tortured or killed unconstitutional on First Amendment grounds, saying free speech protections extend to illegal acts.
