State stole our land for cinema, says railroad

"Norfolk Southern Corp. the second-largest railroad in the eastern U.S., sued developer Buccini/Pollin Group Inc." and the State of Delaware "contending it’s illegally using land to build a movie theater complex that’s a centerpiece of revitalization plans for Wilmington, Delaware," writes Wilmington-based Bloomberg reporter Phil Milford here.
"The Norfolk, Va.-based railroad alleges Buccini," which built the Philadelphia Union soccer stadium in Chester, among other local projects; the state-backed "Riverfront Development Corp. of Delaware, and Lititz, Pennsylvania-based Penn Cinema Management Co. are trespassing on land that was wrongly condemned by the Delaware Transportation Department in an action preempted by U.S. law.
“'Norfolk Southern is now and has been the lawful owner'” of the two-acre parcel, which it uses to sort freight cars for Wilmington's nearby port and other facilities, according to Norfolk Southern's federal court complaint in Wilmington.
