The Eagles have a different take on the "confrontation" that involved Michael Vick that took place before a shooting at a Virginia Beach nightclub that was hosting the quarterback's 30th birthday party.

Virginia Commonwealth's attorney Harvey L. Bryant told WAVY-TV 10 in Virginia Beach that Vick had been involved in one of several "confrontations" at Guadalajara restaurant prior to a codefendant in his dogfighting case being shot. The victim, who suffered a leg wound, has been indentified as Quanis Phillips by Vick's lawyer, Larry Woodward.

""The investigation shows he was not physically present when the shooting took place," Bryant said. "There were some confrontations between individuals and between groups and Michael Vick was involved in one of those confrontations.

"[It was] a confrontation that involved shouting, words passing, some bumping."

Bryant added that Vick had to be restrained by his friends, who then put Vick into a limo, but Vick got out to again confront someone.

"In terms of just using good judgment, at one point, he got in the limousine, and should have left at that point," Bryant said. "He got out of the limousine, and with the help of several friends, he was returned to to the limousine and left."

An Eagles source, however, labels Bryant's depiction of the incident as a "mischaracterization." The team has conducted its own investigation and has yet to take a final stance on Vick's future with the team. The NFL is also in the fact-gathering stage.

Virginia Beach police said Tuesday that they believed they had identified the party's shooter but could not go forward with charges because Phillips would not cooperate.

Bryant later tampered his earlier statements in an interview with the Associated Press. He said Vick was not involved in the shooting and left the nightclub "in the 3 to 5 minute range" before it occurred. Bryant would not go into detail with AP about the confrontation, but said there was no evidence the Philadelphia Eagles quarterback was involved in "anything that would amount to aggressive or assaultive conduct."

"He's an athlete and an entertainer, but he's also a human being, and things that would tick you and I off would tick him off," Bryant said. "But he extricated himself from those things and left with the help and encouragement of some of his friends and supporters."

    Man, wasn't that great the way Dallas destroyed your pathetic team? Expect it again this year you pitiful, dirty Yankee's. One Superbowl,,,,WHOOPDEDOO! America teams has played in 8, and won 5. You Dolts could live to be 250 years old and NEVER experience that like I have!

    thats rediculous. I really dont care much about the dogfighting, and I liked when they got Vick, but if your on parole you do not get out of the limo to continue a confrontation. thats how you get arrested in the first place. He is gonna be sanctioned by Goodell and the eagles might be forced to realease him. Another great job of Andy Reid "outsmarting" all the other coaches in the league. The idiocy will continue until he is fired.

    hanky-this is a different team with a new QB that will not hold the ball with open receivers all over the field,the last game of the season receivers were wide open to win,if mcnoheart could hit an open reciever ie: jackson-celek-maclin..the playoff game mcnoheart waved the white flag and threw the young gums under the bus,you saw what happened to the cowgirls when Brett Favre picked apart the girls with his quick release,,the Birds have a new sheriff in town,KK and the young guns will not wave the white flag like the last lapdog (mcnoheart)did-book it..Birds 2012SB....wolf.

    lol wanker, celebrating a win over a team decimated by injuries. I guess you also enjoy beating up mentally handicapped folks (ie, anyone from TX). While they've lost both, the Eagles have been in two Supes and the Stankees are in NY. No matter tho, I guess you talk to all the cowpukes under 20 about the "good ole days" cause no one under that age could even remember a decent loonstar team

    The prosecutor must not have gotten the memo that he was supposed to say Vick was swinging and throwing bows and kicking and cursing folks out. Well, I guess he must be some sort of Vick fan or something! LOL

    Do we really need another controversial season like we had with Owen's? Vick contributes nothing to the Eagle's! This is a new team, so why not just move on, without Vick? What is it it with the 'fat man', anyway? Does he want to win, or does he want 'headlines?'

    Hanker: If a team winning the Super Bowl is the highlight of your life, then there is nothing for anyone to be jealous about. Sports only takes on such meaning for people that are as deep as a filled-in pothole and have little else of which to be proud.

    Can appreciate that the Eagles want a thorough investigation; and give Vick the benefit of the doubt...etc. This story looks to drag into training camp. Seems obvious that Quanis Phillips was at party for several hours before the dust-up at the birthday cake: he should have been removed immediately--OR--Vick could have left. The two men clearly associated at the cake smearing and later in some face-to-face shouting and jabbing. It was DUMB of Vick to be there at all. There will be a consequence.
