Library Lawsuit To Go Ahead

Attorney Irv Ackelsberg plans to file a class-action lawsuit today on behalf of a group of Philadelphians to try to stop Mayor Nutter from closing 11 libraries.

Ackelsberg last week announced that he would file the suit unless Nutter pledged to keep the libraries open. The suit, which he will file in the Court of Common Pleas, argues that Nutter is violating a city ordinance which states that city-owned facilities cannot be closed without approval from City Council. Seven residents are listed as plaintiffs, as well as local labor union District Council 47.

City Solicitor Shelley Smith has said the administration holds that ordinance is invalid.
