City to Appeal Mariano Pension Decision

The city pension board plans to appeal a judge's ruling last month that the city had improperly confiscated former City Councilman Rick Mariano's pension-fund contributions, totaling $65,438, after he was convicted of mail fraud, money-laundering, bribery and conspiracy in 2006.

Common Pleas Judge Idee C. Fox ruled that the city had a right to seek reimbursement from Mariano for $82,000 in tax dollars, used to provide him with legal representation before he was indicted. But she said the city should have filed a civil claim against Mariano instead of going after his pension money.

Mayoral spokesman Doug Oliver said the city pension board will appeal the decision in Commonwealth Court this week.
