The Los Angeles Times, May 7, 2010:

The Senate confirmation hearings for the Supreme Court have become "a vapid and hollow charade," a Chicago law professor complained, because the nominees are not forced to say what they think about disputed issues such as abortion, affirmative action and privacy.

It is "an embarrassment," she said, that "senators today do not insist that any nominee reveal what kind of Justice she would make, by disclosing her views on important legal issues."

In 1995, Elena Kagan said it, and in 2010 Elena Kagan lived it. Now she will become the 112th justice of the United States Supreme Court.

Congratulations...I guess.

    Isnt that true of all elected (or in this case nominated) officals? Try to skirt the issue on hot button topics so as to not offend any voters who dont agree? Heck, even if I completely disagreed with a politican on an issue I'd respect them if they actually stood up for it. Then again, thats assuming the polticians in power are something aside from spineless, sell out talking heads.

    Idiots. Judges are supposed to - just like jurists - leave their private feelings and opinions at the door when they come to work. This is especially the case with Kagan, who is an academic and not a judge, and therefore can be expected to look at things critically and in a detached manner. (Or so we hope.) Point is, I wouldn't expect her to outlaw peanut butter just because she's allergic, would you?

    citylumberjack, just wondering then how you felt about Sonia Sotomayer's appointment. Way back then we were told that personal empathy was more important than critical, analytcal, detached judgement. (IMHO - detached judgement makes the best law)

    Will, I believe it may be time for an Update on your earlier post "A Judge Out of Time" - you should probably edit you line in there which reads "He is currently one of only THREE openly gay federal judges." - NTTAWWT

    So easy to talk big about a charade - yet she went right along with it to get that prize at the end -- regardless of what party you are she showed her true colors - when the ends justify the means she throws her big talk right out the window when pressed with a golden egg. She seemed very accepting of this dog and pony show of stupid questions that really did not deal with law too much. And I do see a real issue having someone who was never a judge sit on the high court as a judge. She has ruled on nothing and we are not sure HOW she rules. clj puts too much faith in academic and looking critically because she looked at how supreme court justices were picked critically, but when it was her turn, the process was flawless. So would she outlaw peanut butter, her record shows if there is prize at the end - I am along for the ride..........
