Valley Club to file for bankruptcy

Minority kids were kept from swimming there.

The Valley Club apparently plans to put itself out of business.

The community swimming pool in Huntingdon Valley gained national notoriety during the summer amid allegations that racism was behind its decision to expel a group of minority children from swimming at the club.

The board voted, 5-1, last week to file for Chapter 7 bankruptcy, according to an e-mail to members by board president John Duesler.

The Philadelphia Daily News quoted Duesler as writing: "While many will point towards our legal situation and negative media exposure this summer as the reason, the truth is that the club has struggled to stay out of the red for at least the last decade. . . . And our current debt from this year's operations and legal fees now exceeds $100,000."

Duesler said last night: "I won't be making any further comment about this."

Other club members said they, too, had no comment.

To generate revenue, leaders invited children from the Creative Steps Summer Day Camp in Northeast Philadelphia to use the pool. But after 56 children made their initial visit June 29, some club members complained, with one allegedly asking why "black kids" were there. Duesler refunded the club's $1,950 fee and ended the arrangement.

The state Human Relations Commission in September found probable cause for race discrimination, and ordered a $50,000 civil penalty.

The Justice Department is also investigating.

The club has been sued by one parent and faces another suit. Brian Mildenberg, an attorney for the children, told the Associated Press that the bankruptcy court would decide whether to allow any lawsuits to proceed.

As I said before, hate groups will step in to twist Valley Club's bankruptcy to blame Creative Steps for it. Had the Director of Creative Steps went out of her way to forgive the members of Valley Club for their behavior, this would have been seen as an extraordinary step. But she chose to hide behind the coats of the NAACP/Human Relations Commission to leave the swim club twisting in the dark. Now we know the reason why they filed under Chapter 7 was because of financial losses from declining membership over a decade. I am sure Brian Mildenberg knew the swim club was going to file for bankruptcy, given the declining membership and increasing operating costs, but he, himself, went along with Creative Steps to humiliate the membership instead of extending a hand of reconciliation to them which would have been quickly accepted.

1) $50,000 in fines 2) tens of thousands more in legal fees 3) multiple pending lawsuits. The 150 families that make up this small PRIVATE swim club could never absorb this kind of debt. I hope the club files for bankruptcy...re-incorprates...and reopens in June. This will make me happy: Alethea won't get Creative Steps out of debt and these parents looking for a pay day won't get one nickel. Too bad for the kids though...now, as private clubs will reject such outside temp membership arrangements for fear of accusations, media circuses, and lawsuits. That's too bad as it seems unlikely Philly will have open pools this year.

Personally I would not take my kids into areas that are prone to this type of redneck behavior. People coming into the city are no more at risk from stupid behavior than people from the city venturing into redneck suburban communities.

Ha ha. Looks like the tail just wagged the dog. Chapt 7, shed the debt and fines and this club will be back, sans invites to outside groups. Guess who lost this war...

People are unbelievable, "Guess who lost this war", "whiners" it is undeniable that race had something to do with this. It is unfortunate that the American way is to sue, but people continue to do so. However, the $50,000 awarded to the Camp will probably help these children in more ways than any of us realize...not a payday, but an opportunity. The Swim Club will likely not be sued again, reopen and be better off than before...sounds like a win, win.

Kind of a shame.. I don't support the way those kids were treated but with all the public pools closing, it'd be nice to have more private ones around. I'm still bothered more by the fact that the media made it basically impossible for the public to ever have a reliable source as to what actually happened there.
