Two families sue in body-parts theft case

Relatives of two Philadelphians whose remains were allegedly desecrated by a body-parts theft ring filed a lawsuit yesterday seeking damages for themselves and other victimized families.

The complaint names alleged ringleader Michael Mastromarino, the owners and operators of two Philadelphia funeral homes and a cremation facility, and the firms that received the body parts for processing for transplantation.

The families of Felicia Pancoast and James L. Bonner said neither they nor their deceased relatives had given permission for body parts to be harvested for medical use. Pancoast, 59, died Sept. 24, 2005, of lung and bone cancer, the suit says. Bonner died May 31, 2004.

The complaint, which seeks class-action status and was filed in Common Pleas Court, said the remains of both had been entrusted to Liberty Cremation, a defendant.

Liberty was owned by Philadelphia funeral-home operators James McCafferty Jr. and brothers Louis and Gerald Garzone, who also are named as defendants in the civil suit and are awaiting trial on criminal charges.

Officials have said McCafferty and the Garzones pocketed $250,000 for providing 244 bodies to the theft ring.

Mastromarino, a New Jersey oral surgeon, has pleaded guilty to charges in New York and is negotiating a plea agreement with Philadelphia prosecutors in hope of getting a sentence concurrent with his 18- to 54-year term in New York.

The complaint spells out 16 counts of negligence, fraud, deception and emotional distress. It seeks judgments of more than $50,000 for each count plus punitive damages.

The plaintiffs' attorneys, Lawrence R. Cohan and Melissa Fry Hague, have filed other suits arising from the case here and other areas of the country.

Officials have identified only about 50 of the 244 bodies from Philadelphia supplied to the ring.
