Law prof: N.J. and Del. likely to win dredging fight

WILMINGTON - A Widener University law professor says the law is on the states' side in a lawsuit about Delaware River dredging.

Jim May says Delaware and New Jersey have the upper hand in a case mixing interstate and intergovernmental issues. He says the environmental questions also lean in the states' favor.

The states are suing the U.S. Army Corps of Engineers because they claim the agency is going ahead without their approval to deepen the river channel by 5 feet.

The states are seeking a federal injunction against the work, planned from Philadelphia to the mouth of the Delaware Bay.

I hope he is right. This project has no ecomomic benefits for Delaware or South Jersey.
