Judge rejects restraining order request from Donaghy's wife

A Florida judge yesterday dismissed a request for a restraining order that former NBA referee Tim Donaghy's estranged wife had filed against him last week.

Kimberly Donaghy said in court papers that her husband is "going to snap" and accused him of abusing their four children. "I am scared for myself and my children," she wrote.

Apparently not scared enough to show up for court.

Manatee County Judge Peter Dubensky dismissed her petition for court-ordered protection after Kimberly Donaghy failed to appear yesterday, the Bradenton Herald reported.

Tim Donaghy's lawyer, Edward Sobel, told the judge that the pair shared an Easter dinner on Sunday, the newspaper reported. Sobel did not return a phone call from the Daily News.

The Donaghys, who married in 1995, are in the midst of divorce proceedings.

The former referee is scheduled to be sentenced next month after pleading guilty last year to charges he conspired to engage in wire fraud and transmitted betting information across state lines. He faces up to 25 years in prison. *
