Tattle: Eminem's suit vs. Apple is heading for trial

EMINEM's music publisher, Eight Mile Style, and a co-plaintiff, Martin Affiliated, are suing Apple, claiming they never authorized the use of 93 songs in a downloadable format on iTunes.

They're also suing Aftermath Records, which controls the recordings, saying it didn't have the right to make deals on digital downloads.

A non-jury trial in Slim Shady's hometown of Detroit is scheduled for tomorrow unless a settlement is reached today with the help of U.S. Magistrate Judge Virginia Morgan.

Potentially millions are at stake.

Apple denies the allegations and says it has a valid agreement with Aftermath Records.

Eight Mile agreed in 1998 and 2003 that "Eminem would create master sound recordings embodying compositions, and that Aftermath would own those masters," Apple's attorneys said in a court filing.

"The parties also agreed that Aftermath and its distributors and licensees would 'have the exclusive right' to exploit the masters embodying the Eminem compositions 'in any and all forms of media now known or hereinafter developed,' " the lawyers said.

Jewel heist?

Michael Lawrance Kozelka must think he's one of the Blues Brothers.

He is accused of stalking singer-songwriter Jewel at her Texas ranch and told Erath County Sheriff Tommy Bryant that he did it because he was "on a mission from God."

Kozelka was arrested after he "visited" the 2,000-acre ranch owned by Jewel's husband, rodeo champ Ty Murray, on two successive days - on the second day returning with a pocket knife and a dog.

Sounds like the type of guy who might try to stab Jewel . . . with the dog.

"He was not aggressive and was not mad," Bryant told the Associated Press yesterday. "He just said he was on a mission from God, that God told him to come to Stephenville and led him to this ranch."

As if God would waste time talking with Kozelka during football season.

Tom Brady's shotgun wedding?

Two photographers have sued New England Patriots quarterback Tom Brady and his superdupermodel wife, Gisele Bundchen, for $1 million, saying they were shot at during a post-wedding party in Costa Rica.

That's right, shot at.

The suit was filed yesterday in Manhattan.

The photographers and the Agence France-Presse news agency accuse Brady and Bundchen of negligently hiring security for the April party, two months after their wedding.
